Presidential Memoranda: China, Social Media, Supercomputers

Here are some more Presidential Memoranda for your consideration.

Addressing China's Laws, Policies, Practices, and Actions Related to Intellectual Property, Innovation, and Technology

This memorandum was issued on August 14, 2017.  It is addressed to the US Trade Representative.  The memorandum has 3 sections.

Section 1

This section defines the policy which is to pursue trade that strengthens the US.  The argument presented is that China has implemented laws that drive the transfer of technology and intellectual property to China in a way that negatively impacts American economic interests.

Section 2

This section directs the US Trade Representative to determine whether to investigate China's laws in accordance with 19 USC 2412.  This has resulted in this notice of the initiation of an investigation which held a public hearing on October 10, 2017.  The docket on Regulations.gov contains 71 comments as well as the transcripts of the hearings.

Section 3

This section includes the necessary legal fine print to assure that it is not interpreted as overstepping the powers of the Executive as defined in the Constitution.  Further, it directs that the memo be published in the Federal Register.

Delegation of Authority Under the Department of State Authorities Act, Fiscal Year 2017

This memorandum was issued on June 29, 2017 and is addressed to the Secretary of Homeland Security.  This simply delegates the authority to submit a report required under section 710 of PL114-323.  The section is entitled "Strategy to combat terrorist use of social media".  Sounds like an interesting report and it is supposed to be unclassified, but not found on searches done so far.

Delegation of Authority Under the National Defense Authorization Act for Fiscal Year 1998

This memorandum was issued on June 29, 2017 and is addressed to the Secretary of Commerce.  This in connection with section 1211 of PL105-85 which has to do Export Administration Regulations regarding supercomputers.
